The company gave itself a month to come out with a firm stance regarding how it would address royalties enforcement for existing collections. Several options, including optional royalties \u2014 and 0 percent royalties \u2014 were in the mix.<\/li>\n<\/ul>\n<ul>\n<li>Following severe backlash and strident vocal opposition to the proposal from the NFT community, however, <a href=\"https:\/\/twitter.com\/opensea\/status\/1590466334814785537\" target=\"_blank\" rel=\"noreferrer noopener\">OpenSea announced<\/a> on November 9 that it would continue to enforce creator fees for all existing collections.<\/li>\n<\/ul>\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"\/>\n<h2>Why it matters<\/h2>\n<p>The <a href=\"https:\/\/nftnow.com\/features\/nft-community-is-split-over-creator-royalties\/\" target=\"_blank\" rel=\"noreferrer noopener\">royalties debate<\/a> in the NFT community is one of the space\u2019s most important and consequential discussions. Widely considered to be one of the founding tenets of Web3, royalties have allowed artists to sustain themselves in a way previously not possible in the <a href=\"https:\/\/nftnow.com\/features\/the-art-world-has-a-problem-but-nfts-may-offer-a-real-solution\/\" target=\"_blank\" rel=\"noreferrer noopener\">traditional art world<\/a>. Via a combination of earning money through primary sales and taking a small cut every time their NFT changes hands, royalties lend credence to the Web3 community\u2019s claim that NFTs help chip away at the \u201cstarving artist\u201d trope that has robbed artists of dignity for centuries. They have helped lift people out of poverty, pay off loans, and gain economic independence. That\u2019s to say nothing of the countless NFT projects involved in building and sustaining entire sub-communities on the back of such fees.<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Gm <a href=\"https:\/\/twitter.com\/opensea?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">@opensea<\/a> don&#8217;t deprive independent artists from royalties. <br \/>Royalties are door openers for creators, a way to make regular income from their craft, something that did not exist until Web3. They give power &amp; autonomy to artists like never before. Don&#8217;t take that away.<\/p>\n<p>\u2014 Yam (@YKarkai) <a href=\"https:\/\/twitter.com\/YKarkai\/status\/1589960913389772800?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">November 8, 2022<\/a><\/p><\/blockquote>\n<\/div>\n<\/figure>\n<p>According to a late October study by crypto firm Galaxy Digital, more than <a href=\"https:\/\/www.galaxy.com\/research\/insights\/nft-royalties\/\" target=\"_blank\" rel=\"noreferrer noopener\">$1.8 billion in royalties<\/a> have been paid out to the creators of Ethereum-based NFT collections. Notably, OpenSea has paid out the most royalties to creators by a wide margin. But creator royalties aren\u2019t enforceable at a technical level. Ultimately, it\u2019s up to marketplaces to offer and honor them or not. For example, marketplaces like sudoswap and X2Y2 have planted themselves firmly in the zero-royalty camp.<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">If <a href=\"https:\/\/twitter.com\/opensea?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">@opensea<\/a> decide to take the 0% road, you can be sure that every artist I know will get together bring their collectors anywhere else, artists are smart and they adapt, thats what they do everyday.<\/p>\n<p>\u2014 FVCKRENDER (@fvckrender) <a href=\"https:\/\/twitter.com\/fvckrender\/status\/1589782227571068930?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">November 8, 2022<\/a><\/p><\/blockquote>\n<\/div>\n<\/figure>\n<p>OpenSea\u2019s announcement resulted in an <a href=\"https:\/\/twitter.com\/justintrimble\/status\/1589657733812621312\" target=\"_blank\" rel=\"noreferrer noopener\">explosion of commentary<\/a> from nearly <a href=\"https:\/\/twitter.com\/betty_nft\/status\/1589290196239278081\" target=\"_blank\" rel=\"noreferrer noopener\">every prominent figure<\/a> in the <a href=\"https:\/\/twitter.com\/j1mmyeth\/status\/1589766842939486209\" target=\"_blank\" rel=\"noreferrer noopener\">NFT space<\/a>. While many were happy that OpenSea decided to take a stand to support artists and new collections by introducing a tool that restricts NFT sales to marketplaces that enforce creator fees, many more were dismayed that it was seemingly abandoning its existing collections. Those collections, the community noted, were part of the reason OpenSea grew to become the number one NFT marketplace in Web3.<\/p>\n<div class=\"wp-container-3 wp-block-columns\">\n<div class=\"wp-container-2 wp-block-column\">\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">I have opened my DMs. If you\u2019re a project founder please message me and I will provide you with a form to register your interest for a group call to discuss the implications of what <a href=\"https:\/\/twitter.com\/opensea?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">@opensea<\/a> is proposing as well as our moves together as leaders in the space.<\/p>\n<p>\u2014 BETTY (@betty_nft) <a href=\"https:\/\/twitter.com\/betty_nft\/status\/1589688250398306304?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">November 7, 2022<\/a><\/p><\/blockquote>\n<\/div>\n<\/figure>\n<\/div>\n<\/div>\n<p>\u201cUnfortunately, the bitter pill is that, to the best of our knowledge, the only way to achieve on-chain creator fee enforcement for existing collections with non-upgradeable smart contracts is to take drastic measures with their communities, like shifting the canonical collection to a new smart contract,\u201d wrote OpenSea CEO Devin Finzer in the blog post. \u201cIn our opinion, by far the better option is for existing creators to explore new forms of monetization and alternative ways of incentivizing buyers and sellers to pay creator fees, and to ensure that future collections enforce creator fees on-chain.\u201d<\/p>\n<h2>What\u2019s next<\/h2>\n<p>To OpenSea\u2019s credit, the company and its CEO were receptive to the community\u2019s frustrations at the news. Finzer spent days making the rounds in Twitter Spaces, fielding questions from an understandably agitated user base. And while neither he nor the company\u2019s Twitter handle were initially very helpful in clarifying what exactly would happen to existing collections after its December 8 deadline passed, they decided to heed the voice of the creators and collectors that power its platform.<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">UPDATE: We will continue to enforce creator fees on all existing collections.<br \/>\ud83e\uddf5\u2b07\ufe0f<\/p>\n<p>\u2014 OpenSea (@opensea) <a href=\"https:\/\/twitter.com\/opensea\/status\/1590466334814785537?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">November 9, 2022<\/a><\/p><\/blockquote>\n<\/div>\n<\/figure>\n<p>The move is an encouraging one. While marketplaces (including OpenSea) that support creator royalties have a long way yet to go to better enshrine creator rights in their platform infrastructure, the fact that the NFT community was able to influence one of the largest organizations in the industry is a win that\u2019s difficult to understate.<\/p>\n<h4 id=\"h-but-wait-there-s-more\">But wait!
