This argument challenges a recent ruling that found Ripps guilty of illegally replicating <a href=\"https:\/\/nftevening.com\/bored-ape-yacht-club-the-avatar-collectibles-with-the-biggest-community\/\" target=\"_blank\" rel=\"noopener\">Bored Ape<\/a> NFTs. It suggested that even as intangible assets, these NFTs still constitute goods under the Lanham Act.<\/p>\n<p>A cornerstone of Mason Rothschild\u2019s case relies on a 2023 decision from the Dastar Corp vs. Twentieth Century Fox Film Corp. In this case, Rothschild claims that the Lanham Act only applies to tangible goods and potential confusion about their origins. Therefore, it argues, it excludes art.<\/p>\n<p>He explains that \u201cYuga Labs\u2019 use of the \u2018Bored Ape\u2019 mark identifies the creators of the Bored Ape images. And that the NFTs convey unique ownership of the image.<\/p>\n<p>However, Herm\u00e8s lawyers have swiftly dismissed Rothschild\u2019s argument. They stated that it merely rehashes previously rejected claims from the Bored Ape case. The plaintiff stressed that Rothschild\u2019s interpretation of the trademark could potentially pave the way for rampant infringement.<\/p>\n<h2><span id=\"What_was_the_Hermes_case_about\">What was the Herm\u00e8s case about?<\/span><\/h2>\n<p>Earlier this year in February, Herm\u00e8s successfully convinced a New York jury that Rothschild had violated intellectual property laws with his MetaBirkins.<\/p>\n<p>The MetaBirkins case has a significant bearing on the Bored Ape Yacht Club (BAYC) ruling last month. U.S. District Judge John Walter ruled that Ryder Ripps and Jeremy Cahen had breached federal laws by using the Bored Ape logo to market counterfeit NFTs.<\/p>\n<p>The duo was accused by Yuga Labs of generating $500 million through a pump-and-dump scheme selling fake Bored Ape tokens. They allegedly used Yuga Lab\u2019s trademarks to build social media credibility for their collection.<\/p>\n<p>As the legal battle unfolds, it\u2019s clear that Rothschild\u2019s challenge could have profound implications.
