From the <a href=\"https:\/\/nftnow.com\/guides\/understanding-memecoins-how-to-buy-pepe-and-more\/\" target=\"_blank\" rel=\"noreferrer noopener\">rise of $PEPE<\/a> bringing renewed excitement to crypto and NFTs to an unprecedented rugging from <a href=\"https:\/\/nftnow.com\/features\/pixel-penguins-how-an-nft-scammer-faked-a-cancer-charity-to-raise-117k\/\" target=\"_blank\" rel=\"noopener\">anonymous creator hopeexist<\/a>, it\u2019s become difficult for Web3 to focus on anything <a href=\"https:\/\/nftnow.com\/guides\/memecoin-mania-the-most-popular-memecoins\/\" target=\"_blank\" rel=\"noreferrer noopener\">besides memecoins<\/a> and <a href=\"https:\/\/nftnow.com\/news\/coinbase-boycott-explained-pepe-community-reacts-to-hate-symbol-label\/\" target=\"_blank\" rel=\"noreferrer noopener\">scandals<\/a>.<\/p>\n<p>And we\u2019re not quite out of the woods yet. Thanks to <a href=\"https:\/\/twitter.com\/eth_ben\" target=\"_blank\" rel=\"noreferrer noopener\">Ben.eth<\/a>, the inhabitants of the metaverse might be in for another bout of controversy. Having made a significant splash with his <a href=\"https:\/\/nftnow.com\/features\/7-million-in-72-hours-inside-ben-eths-controversial-memecoin-empire\/\" target=\"_blank\" rel=\"noopener\">$BEN and $PSYOP memecoins<\/a>, the pseudonymous collector has returned to further expand his journey to infamy with a new token offering: $LOYAL.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-what-is-loyal\">What is $LOYAL?<\/h2>\n<p>$LOYAL is the third (and perhaps last?) memecoin in the Ben.eth saga. While $BEN was created simply to be a new, viral memecoin, and $PSYOP was launched to be the sequel which would also yield unspecified utility, $LOYAL is supposedly something else entirely. <\/p>\n<p>As <a href=\"https:\/\/twitter.com\/Bitboy_Crypto\/status\/1663378081212518402?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">per a tweet<\/a> by the controversial <a href=\"https:\/\/twitter.com\/Bitboy_Crypto\" target=\"_blank\" rel=\"noreferrer noopener\">crypto content creator<\/a> and $BEN ecosystem lead, Bitboy,  $LOYAL will be \u201cthe token of a new DEX\/Memecoin Launchpad named PsyDex.\u201d<\/p>\n<p>\u201cTwenty-five percent of LP profits on $LOYAL will get airdropped each week to $BEN coin holders. Twenty-five percent of LP profits on $LOYAL will go to fund our crypto adoption initiatives with $BEN,\u201d Bitboy said <a href=\"https:\/\/twitter.com\/Bitboy_Crypto\/status\/1663378083183751175?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">in a thread<\/a> following his initial tweet. <\/p>\n<p>\u201cThe Memecoin Launchpad will allow crowdfunding that automatically locks a percentage for liquidity. It\u2019s rug-proof. Many more things to come and details to work out, but this is weeks into development from the top-shelf dev team.\u201d<\/p>\n<p>Considering the delay and subsequent lackluster response to the launch of $PSYOP, it\u2019s anyone\u2019s guess whether or not what Bitboy says might be true or if efforts might fall by the wayside. But as of writing, the $LOYAL contract had only <a href=\"https:\/\/twitter.com\/eth_ben\/status\/1663986250045607936?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">just been released<\/a>.<\/p>\n<p>Yet, what might potentially be even <em>more<\/em> interesting about the $LOYAL launch (even more so than its tokenomics) is the new layer of controversy that it, and Ben.eth\u2019s previous comments, have inspired.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-copycats-galore\">Copycats galore<\/h2>\n<p>Although there is plenty to be said about $LOYAL and Ben.eth\u2019s previous two coins, it might be his infamous tweet, rather than token endeavors, that has made the most significant impact on Web3 culture thus far. Originally published as a statement to incite potential investors to join a $PSYOP presale, it has since become both a meme format and a call to action for numerous other influencers.<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full is-resized\"><figcaption class=\"wp-element-caption\">Credit: Ben.eth<\/figcaption><\/figure>\n<\/div>\n<p>Though Ben.eth\u2019s above tweet has since been deleted, various versions of his original vernacular have been reissued throughout Web3. But not everyone has been successful, and most creators and collectors in Web3 seem to be opposed to such ventures <a href=\"https:\/\/twitter.com\/redactedpride\/status\/1663555717431975937?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">for obvious reasons<\/a>.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p lang=\"en\" dir=\"ltr\">Instead of sending eth to random addresses to get nothing, why not look through the profiles of artists that haven\u2019t had a sale in a while and send eth in exchange for art and good karma.<\/p>\n<p>\u2014 BETTY (@betty_nft) <a href=\"https:\/\/twitter.com\/betty_nft\/status\/1663666675516882944?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">May 30, 2023<\/a><\/p><\/blockquote>\n<p>Ben.eth\u2019s tweet isn\u2019t the only thing inspiring harmful copycats. A slew of new memecoins has cropped up, aiming to mimic the influencer\u2019s speech and persona in hopes of achieving similar success. Two such endeavors that have been making the rounds are $DAVE and $FINALE.<\/p>\n<p>Although the rumor that $DAVE was under the same management as $BEN was quickly <a href=\"https:\/\/twitter.com\/Bitboy_Crypto\/status\/1663179681275822084\" target=\"_blank\" rel=\"noreferrer noopener\">nipped in the bud by Bitboy<\/a>, the narrative surrounding $FINALE is a bit more complex. Because at face value, and thanks to Ben.eth\u2019s <a href=\"https:\/\/twitter.com\/eth_ben\/status\/1663317616562434049\" target=\"_blank\" rel=\"noreferrer noopener\">failure to denounce the coin<\/a>, the token feels very much on brand with both $BEN and $PSYOP \u2014 and has gained some traction in response.<\/p>\n<p>Furthermore, the Finale Token, launched <a href=\"https:\/\/twitter.com\/TheFinaleToken\/status\/1663174854080643072?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">on May 29<\/a>, continues to reference both $BEN and $PSYOP on social media as a marketing tactic. Although the coin seemingly got a green pass from Ben.eth, Bitboy has remained steadfast that while its progenitors might be <a href=\"https:\/\/twitter.com\/Bitboy_Crypto\/status\/1663256773208178697?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">loosely affiliated<\/a> with the $BEN ecosystem, it is not an accepted part of his or Ben.eth\u2019s ongoing efforts.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-the-legality-of-this-whole-spectacle\">The legality of this whole spectacle<\/h2>\n<p>While the NFT community continues to make their own judgments about what Ben.eth has created, what will ultimately matter most is the legality of his actions. Ben.eth may seem uninterested in the potential ramifications of his memecoin empire. But with attorney\u00a0<a href=\"https:\/\/twitter.com\/MikeKanovitz\" target=\"_blank\" rel=\"noopener\">Mike Kanovitz<\/a>\u00a0already considering filing a\u00a0<a href=\"https:\/\/twitter.com\/MikeKanovitz\/status\/1659611715623960579?s=20\" target=\"_blank\" rel=\"noopener\">class action lawsuit<\/a>\u00a0against the influencer, it may only be a matter of time until Web3 sees the true scope of this complex situation.<\/p>\n<p>In the opinion of <a href=\"https:\/\/twitter.com\/RossowEsq\" target=\"_blank\" rel=\"noreferrer noopener\">Andrew Rossow<\/a> \u2014 an attorney and journalist who focuses on fintech and intellectual property law \u2014 although it\u2019s still much too early to tell what the Ben.eth saga will mean for memecoins, its legal implications should be of interest to everyone within Web3.<\/p>\n<p>\u201cI think anybody participating in the space that is taking on the position of offering up an opportunity for another party or group of people to invest should take this very seriously,\u201d Rossow said in an interview with nft now. \u201cReason being is when you ask somebody to invest their money into an effort, an enterprise, an initiative, you take on an entirely different role and responsibility that we are now just starting to peel the layers back on and hoping for more regulatory clarity on.\u201d<\/p>\n<figure class=\"wp-block-pullquote\">\n<blockquote>\n<p>\u201cIf people are willing to ask others for their money to invest in something [\u2026] they need to be open to the potential of probes and SEC conversations.\u201d<\/p>\n<p><cite>Andrew Rossow, ESQ<\/cite><\/p><\/blockquote>\n<\/figure>\n<p>Rossow made it clear that the Ben.eth situation is far too fresh to truly dissect, but that the ongoing <a href=\"https:\/\/www.investopedia.com\/sec-vs-ripple-6743752\" target=\"_blank\" rel=\"noreferrer noopener\">Ripple vs. SEC lawsuit<\/a> and further <a href=\"https:\/\/nftnow.com\/news\/while-crypto-exchanges-seek-regulation-the-sec-eyes-punitive-steps\/\" target=\"_blank\" rel=\"noreferrer noopener\">regulatory considerations<\/a> made by the SEC will play a major role in if and when memecoin creators (like Ben.eth) or even general NFT project founders should be concerned.<\/p>\n<p>\u201cThe SEC is going to have to get involved, whether we like it or not.
